تلقت منظمة الدفاع الدولية ببالغ الاسف خبر اعتقال الكاتب والناشط الحقوقي الاستاذ مصطفى اسماعيل، ذلك الخبر الذي نجم عنه ادانة شديدة من قبل نشطاء حقوق الانسان في جميع انحاء العالم.

تستنكر منظمة الدفاع الدولية هذا الاعتقال التعسفي وتطالب بالافراج الفوري عنه اذ انه اعتقل فقط بسبب ارائه وانشطته السلمية.
وتشجع الدفاع الدولية على الانضمام الى هذه الحملة المعلنة ضد عمليات استهداف  النشطاء.

القضية:

علمت منظمة الدفاع الدولية بان السلطات السورية، متمثلة في فرع الأمن الجوي بمدينة حلب اقدمت على اعتقال الكاتب مصطفى اسماعيل في 12 ديسمبر 2009 لاسباب غير معروفة ولكن يُعتقد بان يكون سبب الاعتقال هو نشاطه الاعلامي وادلائه بارائه على شاشات القنوات المرئية والمحطات الاذاعية.

ويُعتقد بانه محتجز الان بمعزل عن العالم الخارجي مما يضعه فى خطر التعرض للتعذيب او غيره من ضروب سوء المعاملة.

وقد تحمل الاستاذ اسماعيل الامرين في السنوات الماضية وقد سجل الرقم القياسي للاستدعاءات الأمنية التي بدأ يتعرض لها منذ عام 2000، حيث كان اعتقاله الاول الذي دام لأسابيع في فرع الأمن السياسي بحلب وبعدها استمرت حملة الاستدعاءات وحتى الشهرين الأخيرين، حيث تم استجوابه في فرع الأمن السياسي بتاريخ 3 أكتوبر، ومن ثم استدعائه إلى جهاز الأمن العسكري بتاريخ 5 أكتوبر، وثم استجوابه في فرع أمن الدولة لمدة يومين بتاريخ 7 و8 نوفمبر.

رأي ومطالب منظمة الدفاع الدولية:

تستنكر منظمة الدفاع الدولية استهداف نشطاء المجتمع المدني وتدين اعتقال الاستاذ مصطفى اسماعيل بعد يومين فقط من حلول الذكرى السنوية للإعلان عن الاعلان العالمي لحقوق الإنسان. نأمل ان تضمن  السلطات السورية بان جميع النشطاء في سوريا سيكونون قادرين على مواصلة نشاطاتهم السلمية والمشروعة دون خوف من ان يصبحوا عرضة للاعتقال او التعذيب او سوء المعاملة او غيرها من انتهاكات حقوق الانسان.
حالات المضايقات والتخويف والاعتقالات هذه ما هي الا انتهاك مباشر للحق في حرية التعبير، وانتهاك للعهد الدولي الخاص بالحقوق المدنية والسياسية، والذي سوريا دولة طرف فيه، وكذلك انتهاك لاعلان الامم المتحدة بخصوص المدافعين عن حقوق الانسان، الذي اعتمدته الجمعية العامة للامم المتحدة في كانون الاول/ديسمبر 1998. هذا الاعلان يضع الخطوط العريضة لواجب الدول في اتخاذ جميع التدابير اللازمة لحماية جميع النشطاء من العنف والاجراءات التعسفية.

كتابات الاستاذ اسماعيل ماهي الا تعبير عن الرأي وعن الحلم الذي يتمناه ان يتحقق، حلمه بسوريا خالية من حملات الاستدعاءات التعجيزية والاستجوابات الأمنية ـ سوريا تطلق الحريات وتفتح المجال لكل الآراء والأفكار، ولا تحاسب أبنائها على حقهم في التعبير، ذلك الحق الذي كفله الدستور السوري.

تدعو منظمة الدفاع الدولية السلطات السورية الى الافراج الفوري عن عضو منظمة الدفاع الدولية الاستاذ مصطفى اسماعيل ، دون اي قيد او شرط، لانه سجين ضمير اعتقل لمجرد تعبيره السلمي عن ارائه تماشياً مع الحقوق الاساسية للانسان كحرية التعبير.

ونحث السلطات السورية على توفير الضمانات الفورية بان السيد اسماعيل لن يتعرض للتعذيب أو لاي نوع من انواع سوء المعاملة، وذلك لكون سوريا دولة طرف في اتفاقية الامم المتحدة لمناهضة التعذيب.
وعلاوة على ذلك فان للسيد اسماعيل الحق بالاتصال الفوري بمحامي يختاره هو بنفسه وله الحق ايضاً في اللقاء بأسرته ولتلقي اي علاج طبي قد يكون بحاجة اليه.

I am concerned that he is being held incommunicado, putting him at risk of torure and other kinds of ill-treatment. I urge you to provide immediate guarantees that Mr. Mustafa Ismail will not be tortured or otherwise ill-treated.

Furthermore I would like to point out that Mr. Mustafa Ismail is a prisoner of conscience, arrested solely for the peaceful expression of his opinions in line with his fundamental human rights to freedom of expression. I call on you to release him immediately and unconditionally.

It is my hope that Your Excellency will ensure that all civil society activists in Syria would be able to conduct their peaceful and legitimate activities without fear of detention, torture or ill-treatment or other human rights violations.

I wish to underline that Mr. Mustafa Ismail has the right to immediate and unrestricted access to his family, a lawyer, and any medical treatment he may need.
